Can employers ask their employees about their COVID-19 vaccination status? Or is this information considered confidential medical information for the individual employee?
According to the EEOC guidelines, each employee’s vaccination information should be treated as private information.
However, since this may be an organization’s daily management information needs with regards to seating plans, workstations, social distancing and rotas for those who work from home, etc., the employer is free to ask this question.
Nevertheless, the employer cannot ask why an employee has not been vaccinated or if/when a person intends to do so. This information is private and confidential, and so will only be given by an individual employee if desired.
